Sold A1200 case from Kickstarter Campaign

I'm selling a place in a queue for A1200 case which (if to believe in a campaign's founder words) will be ready in 6-8 weeks. I paid for three of them, but it turned out I don't need so many but need money for another project :D Color of this brand new, beautiful case is black. If you missed an occasion then, now is a chance to fix that mistake ;) Price - 100 Euro shipped worldwide.

Rules:
- as soon as I get them into my hands, I'm sending one to a buyer;
- if campaign's founder does not finish a project/gets bankrupt or whatever in next two months (counting from payment date) or campaign fails of any reason, I do a full refund to a buyer;

I don't wish to derail anything - so I am only asking the question of the mods here, as I believe this could start to happen more often...

Where do we stand on this rule?

You can only sell what you legally own:
You may only sell what you own, or have been authorised to sell.​

I believe the legalese behind the Kickstarter pledges state that you are not actually 'buying' anything, but just pledging to make an idea a reality - you may not actually get anything back for your money. Ergo, you have not purchased anything and therefore do not 'own' anything.

Sorry, but I was just hoping to get things straight for everyone on this forum - as I said I can see this happening more often in the future.

The way I see it, he is selling something that he owns, or expects to own. He's not reselling a pledge since he is offering a refund if he never receives the item. Thus I don't see any problem with this.

And Telsar, for future reference, if you don't see a price on an item you cannot declare interest. :)

You are correct in that is what the rules state and that is normally the case.

We have made exceptions in the past for bulk buys which have asked for interest before any goods were actually for sale.

Perhaps this case may need more discussion on the rights and wrongs with the other Mods and Admins.

Example - if buyer decides to take the item and sends money to my Paypal account today (15.07.16) but campaigns fails and a final product will not be available to 15.09.16 (2 months from today), I make a full refund to the buyer then. Is it clear now? ;-)

That is clearer. I read it as "If the buyer pays and item is not available within two months of paying it would be tough luck and NO refund given"

Update: Two months passed but cmsj decided to wait more, until cases are ready. We are in contact.
