About selling a Kickstart rom

I can only guess is that systems from the likes of Escom/Amiga Tech sold A1200’s with 3.1 ROMs as standard.
Although it is also dependent on the type of ROM.
For example OEM ROMs (Non-EPROM types etc.) with a “MX” printed on them should be okay.
Don’t forget that Licensing is all over the place. For example:
- Usually for AmigaOS 3.1 it’s with Cloanto. Any EPROM programmed ROMs should have a Cloanto license.
- For AmigaOS 3.1.4 and 3.2 is currently with Hyperion Entertainment. Therefore any ROMs will be EPROM programmed and should have a Licensed copy of the AmigaOS 3.1.4 or 3.2 Software.
Usually anything with up to a Amiga 3.0 original ROM is safe as it was a Commodore provided Chip(s).
3.2 ROM = Hyperion Entertainment. Included on the AmigaOS 3.2 CD. Therefore bought as a set. Which you receive a License code. That code is used to register with Hyperion for updates.
2.04 ROM = Original Commodore C. 1990.
I have seen sales threads where cloanto's 3.1 roms were sold. Is that ok?
I'd like an admin to say what is allowed and what is not.
I know about installed OS in a CF card is not allowed, even if it is a Commodore 1.3.

As long as the Code is given/Transferred to the buyer.

As stated in the the site rules you can only sell what you legally own and it is the same with the Kickstart ROM's
Official Original Commodore kickstarts are OK to sell individually we know they are not copies.
Any Hyperion Entertainment kickstart releases must come with the transferable software licences so the complete OS because the ROM's are apart of the software and sold with it under their copyright
In regards to the Cloanto's kickstarts sold, I will be honest, I have never bought these but if they have a code this should be transferred to the buyer as @boingball stated

AmigaOS 3.2 is still a product that you can buy retail. Therefore it is illegal for anyone to supply non-original media or OS3.2 installations without the corresponding original CD included in the sale.
There is one exemption however ... If I post a set of OS3.2 ROM chips for sale , the buyer has to prove to me that they own an original copy of AmigaOS3.2 (see proof of ownership rules). We are both then legally enttled to complete the transaction.

So if I have bought an original rom from Hyperion I can sell it without the licence or the CD.
The same way as I sell an original 2.05 rom wirhout the os2 disks.

Believe it or not but there is no such thing as "official" physical OS3.2 Kickstart chips. They are mearly ROM chips with the software written to them and supplied by the authorised reseller as a curtesy to you, the buyer. I understand that this was agreed upon by Hyperion Entertainment, the creators of OS3.2 and the resellers as not everyone has the hardware to burn the chips themselves.
This is also why you can buy AmigaOS 3.2 either with or wihtout the physical ROM chips.

Of course I know about this, but my question is if I can sell this rom that I legally bought.They should only sell the rom if you have bought the licence

Ok, why this is different when selling a 2.05 rom?
I can't sell a CF card with os2 in it without providing the installation disks.
So if I want to sell the 2.05 rom I should give the disks too.

A 2.05 ROM is original and came with the machine itself ... an OS3.2 ROM is not and never did.
You can legally sell a 2.05 original ROM without software. You cannot do the same with a 3.2 ROM as it is not original and the license you purchased when buying Amiga OS3.2 stays with you, it is not transferrable.

So what makes the 3.2 rom not original?
It's supplied on the CD ... Which is then burnt to EPROM(s) for your own personal use. That in turn is part of the licence, your legal and offical ownership of the chips if you prefer.
But only YOU have the right to use those OS3.2 chips. If you give up those rights and wish to sell only the chips, then they must go to somebody who already owns a legal (original) copy of AmigaOS 3.2 or you are committing software piracy.
I can not make it any simpler.
