My pride & joy, and my everyday car. Petrol kills me :( Mapped at 356 ponies, but rarely gets used these days. Sold all my console collection for the one before this.

That's a lovely Skyline. I bet the insurance is also a bit of a killer too but worth it :)

That is the tidiest Skyline I think i've ever seen, very jelly here. What the interior like? Just as original?
 
I've only got three wheels on my Mondeo at the moment.

Lincolnshire pot holes have got a lot to answer for - one cracked alloy :mad:
 
You might be able to claim for that from your local council. Look on their website. Mine had a form to download and fill in for claiming damage caused by pot holes.

I had a puncture the other month due to one. Not got any money back from the council to date though. I heard they need to get 2 complaints/claims from a single location before they will pay. I'm surprised they hadn't from the one I hit because it was in a very well used junction and loads of people must have gone down the huge hole. They repaired it a few weeks later and actually Chichester council have been resurfacing a lot of the worst roads this month.

"I write with reference to your recent correspondence, which has been forwarded to us by the North and East Hertfordshire Highways Area Office.

I can confirm that our enquiries are now complete.

Having considered the information available, we do not feel that the County Council has been negligent.

Our investigations have shown that there was no evidence that the said tree was diseased or dangerous prior to your incident. The branch has simply fallen due to the extremely bad weather that we had on this day.

Furthermore no similar incidents were reported or complaints received prior to your incident, therefore the County Council could not have reasonably prevented your incident from occurring.

We therefore regret that we are unable to be of assistance in this instance. If you wish to appeal against our decision, please write to our section with your reasons of appeal. Or alternatively we advise you that at all times you have the right to seek legal advice.

Yours sincerely"


I requested a copy of their 'last dated tree survey'; which was met with no response.

Bummer really as my excess is £400

Low key Honda Jazz 1.4 - low insurance and no-one bothers it at all. Ultra reliable too...

Although I do still have an urge to get an old 1980's Audi quattro... must resist (still into my VAGs but my last was like a money pit)

I can't believe councils sometimes. What difference does it make if one or two people hit a pothole, it's still dangerous and you still have a knackered alloy. And that tree is ridiculous, I'm surprised by their response. In the storms a few years back a chap on the owners club posted a picture of his car with a whole tree on top of it, not sure if he contacted the council tho.

Thanks for the comments btw, the interior is standard, just a few dials. I was Lucky enough to spot it on autotrader just after they listed it, I put a deposit on it over the phone as it only had 22k km on the clock! We have huge potholes around here, but the way they resurface entire roads around here is more annoying. They coat it with glue and spray grit on it.. so for weeks afterwards it sounds like you're getting shot at with millions of tiny stones bouncing up around the arches. Good job council, keep it up. I'd cry if I cracked an alloy or anything like that, i exist on a finely balanced budget, basically means im skint.

Does your insurance have legal cover? Might be worth getting their solicitors on the case. Councils are on a money saving drive so of course they're going to deny it. Keep pushing!
 
I suggest you also contact the highways agency, not just the council, because they are also responsible to some degree for that tree. If the tree is on public/council property and overhanging a road then they do have a responsibility to maintain it and to cover any costs due to it falling and damaging property.

Not quite the same thing, but my dad owned a large woodland in Somerset and he was responsible for any trees that overhung the roads alongside it, and was required to perform the maintenance on them, or to instruct the council to do the work and thensend him a bill.

I would however also write to your PM. As you may or not know my house was flooded again for the second time over Christmas and we have been fighting ever since for someone to own up to being liable for this happening twice now. We initially received back a standard "not our problem" letter from the planning departments, highways agency, water board etc... so we contacted our PM and suddenly they were all interested in coming and having a look and investigating the drains and related systems. Last week we finally received a letter from one of the agencies stating that the balance ponds, ditches and storm drains had not been maintained for a number of years, which led to our flooding, and that work has now been carried out to clear them and return them to full working order, and they have offered to refund us half a year's waste water charges. It's a result, but we are not as interested in the money being offered as we are in the fact this is to some degree them admitting liability, so the letter has now been forwarded to our insurance company's legal department for them to chase recovery of their lose.

Keep at them. I had a similar incident 7/8 years ago. Tree just outside our house fell over in strong winds and smashed the rear end of my car. Luckily it was just rear window/boot damage. Contacted the council who denied any responsibility, saying it was due to adverse weather. Then I replied asking for a detailed tree survey and if they couldn't provide it, I would be taking the matter further. They then coughed up the amount it cost to fix the car (had it done independently already by this point) but still refused to acknowledge responsibility. Well at least I wasn't £450 out of pocket.

Yikes, I came outside to find a huge branch a couple of feet away from my car after the last storm, lucky escape!
