An interesting point
I was under the impression that you were allowed a back up as long as you had the original but since there is no original 3.9 (that I'm aware of ) it would be good to clear it up to see where we all stand I may be totally wrong so dont go flaming please...

I do own legally all the needed software and hardware, but also do remember that flaming from a.org, i might not being registered there long time, but have been reading those forums for a pretty long time. Well, grey area this really is, but asking doesn't cost anything and doesn't hurt anyone

A fair point, but most of the people who get busted for illegal software aren't exactly Einstein either.... :roll:
I am sure that there must be some sort of end user licence agreement regarding the ROM images, stating that you sould not edit, transmit, disseminate, etc., etc.
Copyright still exists for these ROMs as far as I know, as they are still sold. I don't want people thinking that I am being really anal and picky here; I am applying the same AmiBay rules that would apply to copied floppy discs or CDs.

Now, yes there is a cause of concern insofar as directly trading KS3.9 images. let me explain.
KS3.9 is a heavly customized 3.1 ROM image, a lot of things are removed and a lot of things added, depending on
1. Amiga (a500 / a600 / a1200/ a2k / a3k and a4k
2. Type of Accelerator used (i.e Apollo / Blizzard for REMApollo lib or BlizKick Lib)
To make a 3.9 Kickrom you will need a working 3.1 to begin with, this as well all know is under some fangle copyright so there can be NO direct trading on AmiBay for this, hence why theres eab.abime.net
Now, theres nothing wrong with discussion and ideas and wants as at the end of the day, that is all it is... as long as no one is silly and puts a link for download or opens a for sale thread with Buy 3.9 here etc then its perfectly legal and AmiBay is in the clear.
There also nothing wrong with people claiming that they want one / set although one could construde from this that it becomes a sales thread so if you do want help obtaining 3.9 roms, then please... dont post it here.... there are otherways and that way AmiBay is in the clear.

Just to answer some of your concerns m8y
Under UK law any statement like the above is VOID, you are leaglly allowed to improve or add functionality to any code you own, this includes windows vista (not that anyone is insane enough to decompile that sh*te)
Insofar as trading said software then I agree its against site policy to trade copied disks, copied roms is the same thing, modified or otherwise.

I take from your comments that the discussions about EPROM burners and settings are OK in that this is just a technical discussion and there is nothing naughty about this.
No ROM image files should be posted on AmiBay; there are other places where such things can be obtained....although offsite linking to such things on here would also be a no-no.

We completely align on this issue. Reverse engineering is legal. What's in gray area is when you start breaking/cracking digital copyright enforcements (dvd csa, blueray etc)
As the person making his ks3.9 image both own and keep his ks3.1 roms and OS3.9 copy, then I would say that someone is in the clear.
